elissa harrington is on the ground with the latest information what can you tell us. >> reporter: there's mud and water everywhere. this is what we're seeing throughout several blocks in this daly city neighborhood. here here on lasaine and price street and police say that it appears a water main broke somewhere up the hill so the water has been gushing down flooding the streets. some cars have water going past their tires. we have some video a little bit earlier. let's bring that up. residents have been waking up. they tell me because of the sound of o hospitallers. they're -- helicopters. there are police out here, firefighters out here. and when residents walk outside and see this, a lot of them concerned. quite a few have been evacuated from their homes and last we heard, they were going to a nearby park. we have yet to speak with any of those people and are still trying to get updates from police and firefighters, but a a big mess clean up here. when we first arrived it looked like there was gushing water and at this point everything seems to be still. maybe they're getting

"the wall street journal" reports the fbi agent who launched the petraeus investigation was removed from the case after it was discovered he sent a shirtless picture of himself to jill kelly. the agent who knew kelly sent the pictures before the investigation began. he was later removed from the investigation because supervisors were concerned the agent may have become obsessed with the case. >> and there's more. a team of fbi agents searching paula broadwell's home yesterday. eight to ten agents brought cardboard boxes and searched both levels of the house. the fbi confirmed agents were there but wouldn't say what they were looking for. >> obviously, a lot going on here. we have two reports. chris lawrence of the pentagon and brianna keeler in our washington bureau.
fraud charges. he had forged home loan documents to buy a pleasure boat. he had been using his government office to fax the tony documents. brown was back at federal court tuesday to be formerly sentenced but not before he said he had done wrong because of my own poor conduct. i am not a victim. it was stup. i was wrong. brown's mother and wife left the court without comment. brown was detained to serve one day in custody. his sentence also includes two years supervised release. a form of probation. six months of home detention. a 10:00 p.m. curfew and 480 hours of community service. >> he has received a sentence from the court. the court expects that he will abide by the sentence. that meets all of his term. if the curfew is 10:00, he needs to be in at 10:00 so when they turn it on, it goes ping at his home. >> reporter: prosecutors noted he had taken responsibility for his crime, given up his public office and he was cooperating with prosecutors in their investigations. and judge leon said he wanted kwame brown to do his public service, community service out in the public. he

. jeanine della vega is live where the soldier's family lives and tell us what led up to the shooting. >> reporter: public records show that the marine and his family lives here and we have been unable to contact the family inside but we do know his father drove to palm springs to get answers from police and talk to the marines. this is marine corpel the second. he had a confrontation with police and they heard yelling coming from a parking jar wrong and they say the two men were making der rogatory comment and he hit one of the officers while they were firing for their safety. the passenger was uninjured and both officers are on paid administrative leave. his son was based out of camp pendleton and he was about to finish his four-year enlistment in a couple of months. the records show where they live and there is an american flag as well as patriotic stickers. again we are in an effort to contact the family inside to ask them where he went to school and their feelings about this whole incident. jeanine della vague a cnbc. it now involves another top ranking official. general john all
